Terms of Service

ARTICLE 1 – DEFINITIONS

In these Terms of Service, the terms listed below carry the following meanings:

Cooling-off period: The timeframe in which a Customer may use their right to cancel the purchase.

Consumer: Any natural person acting outside the scope of a trade or profession who enters into a Distance Contract with Theya Jewellery.

Ongoing contract: A Distance Contract relating to recurring deliveries of products and/or services over a set period.

Durable medium: Any tool that enables the Consumer or Theya Jewellery to store information addressed personally to them in such a way that it can be accessed later and reproduced unchanged.

Right of withdrawal: The Consumer’s right to cancel a Distance Contract within the Cooling-off period.

Entrepreneur: Theya Jewellery, the entity offering products and/or services remotely to Consumers.

Distance Contract: An agreement concluded via an organised system for remote sales, in which exclusive use is made of one or more methods of distance communication until the contract is completed.

Means of distance communication: Any method by which an agreement can be made without both parties needing to be physically present.

Terms and Conditions: These Terms of Service of Theya Jewellery.


ARTICLE 3 – APPLICABILITY

These Terms and Conditions apply to all offers from Theya Jewellery and to all Distance Contracts concluded between Theya Jewellery and the Consumer.

Before a contract is concluded, the Consumer will be given access to these Terms. If this is not reasonably feasible, Theya Jewellery will explain how the Terms can be viewed and provide them free of charge upon request.

If the agreement is made electronically, the Terms may be provided in a format that allows the Consumer to save and store them on a durable medium.

If additional terms apply to specific services or products, both sets of terms shall apply. Should any provisions conflict, the Consumer may rely on the one most favourable to them.

If any clause within these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Any situation not covered will be interpreted in line with the intent of these Terms.


ARTICLE 4 – THE OFFER

If an offer has a limited duration or is subject to conditions, this will be clearly stated.

All offers from Theya Jewellery are non-binding. Theya Jewellery may adjust or withdraw an offer when necessary.

Product descriptions are made with care and provide enough detail for the Consumer to understand what is being offered. Images are intended to represent the products accurately, though actual colours or minor details may differ slightly.

Obvious errors or mistakes in the offer do not bind Theya Jewellery.

Each offer includes clear information about:

- Pricing (excluding any import VAT or customs charges payable by the customer)

- Shipping fees

- Methods of delivery, payment, and fulfilment

- Whether the right of withdrawal applies

- How long the offer is valid

- The steps needed to conclude the agreement


ARTICLE 5 – FORMATION OF THE CONTRACT

The contract is formed once the Consumer accepts the offer and fulfils its conditions.

For electronic orders, Theya Jewellery will immediately confirm receipt. Until this confirmation is received, the Consumer may cancel the order.

Theya Jewellery will take appropriate technical and organisational measures to ensure secure data transmission and payment processing.

Theya Jewellery reserves the right to verify payment capability and may refuse or impose additional conditions on an order for legitimate reasons.

Upon delivery, the Consumer will receive:

  • Contact details for questions or complaints
  • Information about the right of withdrawal and any exceptions
  • Warranty and after-sales information
  • A copy of these Terms of Service

ARTICLE 6 – RIGHT OF WITHDRAWAL

For Products

The Consumer may withdraw from the purchase within 30 days of receiving the item(s), without providing a reason. Theya Jewellery may request an explanation but the Consumer is not obligated to give one.

The 30-day period begins.

  • The day after the Consumer or an authorised third party receives the goods
  • For multiple items, the day the final item is received
  • For items delivered in parts, the day the last part is received

For Services or Digital Products

The Consumer may withdraw within 30 days from the date of agreement, provided the service or content has not yet been fully delivered.

If Theya Jewellery has not supplied mandatory withdrawal information, the withdrawal period may extend up to 12 months. Once the information is provided, the period ends 30 days thereafter.


ARTICLE 7 – OBLIGATIONS DURING THE COOLING-OFF PERIOD

The Consumer must treat the product and packaging with care. Products may only be handled as would be acceptable in a physical store to examine their nature and functionality.

The Consumer is responsible for any depreciation caused by handling beyond what is allowed unless Theya Jewellery did not provide the required withdrawal information.


ARTICLE 8 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Theya Jewellery may exclude withdrawal rights only if clearly communicated before the transaction.

Exclusions may apply to:

  • Items made to order or personalised
  • Products that cannot be returned for hygiene reasons once opened
  • Goods that deteriorate quickly
  • Newspapers, magazines, software, or audio/video recordings once sealed packaging is broken

Services related to accommodation, transport, catering, or leisure tied to a specific date may also be excluded.


ARTICLE 9 – PRICING

Prices will not be increased during the specified validity period unless due to legal VAT changes.

Theya Jewellery does not charge VAT for exports; any import taxes or customs duties are the Consumer’s responsibility.

No responsibility is accepted for obvious typographical errors.


ARTICLE 10 – CONFORMITY & WARRANTY

Theya Jewellery guarantees that its products meet the terms of the agreement, match the stated specifications, and meet reasonable expectations of quality and usability.

Incorrect or defective products must be reported within 30 days of delivery and returned unused in their original packaging.

Warranty does not cover damage caused by improper handling, unauthorised modifications, or neglecting usage instructions.


ARTICLE 11 – DELIVERY AND PERFORMANCE

Theya Jewellery processes orders with care.

Orders are delivered to the address provided by the Consumer. Shipments will be sent promptly and no later than 30 days, unless otherwise agreed.

If a delay occurs, the Consumer will be informed within 14 days and may cancel the order without charge. Any payments will be refunded within 14 days.

Risk of loss or damage remains with Theya Jewellery until the package is delivered to the Consumer.


ARTICLE 12 – ONGOING CONTRACTS: TERMINATION & RENEWAL

Consumers may terminate recurring or fixed-term contracts for ongoing supply with a notice period not exceeding one month.

Contracts cannot be automatically extended beyond their initial period, except for short trial subscriptions up to three months.

Contracts longer than one year may be cancelled at any time after the first year with one month’s notice.


ARTICLE 13 – PAYMENT

Unless otherwise stated, payment must be completed within 7 working days from the start of the cooling-off period.

The Consumer must promptly notify Theya Jewellery of any inaccuracies in payment details.

In case of non-payment, predetermined and reasonable recovery charges may be applied if previously communicated.


ARTICLE 14 – COMPLAINTS PROCEDURE

Complaints must be submitted in writing within 7 days after the defect is discovered.

Theya Jewellery will respond within 14 days. If more time is required, an acknowledgement with an estimated response timeframe will be provided.

If the complaint is justified, Theya Jewellery will repair or replace the item free of charge.


ARTICLE 15 – GOVERNING LAW

All agreements and these Terms of Service are governed exclusively by UK law, regardless of the Consumer’s place of residence.


ARTICLE 16 – SMS MARKETING

By signing up for SMS notifications from Theya Jewellery during checkout or account creation, you agree to receive recurring text messages regarding your orders, promotional offers, abandoned cart reminders, and service updates. Message frequency may vary. Consent is not a condition of a purchase.

To unsubscribe, reply STOP to any message or use the link provided in the SMS. Other unsubscribe methods may not be recognised. Standard messaging and data rates may apply.

We may change our sending numbers or short codes; if so, we will inform you. Messages sent to outdated numbers may not reach us, and we are not responsible for such cases.

We are not liable for delayed, undelivered, or misdirected messages, nor for actions taken based on SMS content.
